Trial Risks: Credibility

In law school, a professor warned against one major trial peril: Being too in love with your own case. What he meant was, don't become so enamored with your own case such that you lose sight of your own case's blemishes and the other sides good facts. That pointer has been important to me in my 12 years of private practice and appearing in court in Hastings, St. Paul, Stillwater, Cambridge, and other courts.

One of the major issues to address with your own case is credibility. In other words, how believable are you and your story? You can be right all day long, but if your story is not believed, you have an extremely high risk of losing.

A major way to boost your credibility is to have documentation support. E-mail is a wonderful instrument. If you can testify to your story and use e-mails to support your story, or that are consistent with your story, your credibility should be very high.

Understanding your litigation risks and downsides is something I think I do extremely well and very fairly. I don't lead you to believe you have a good case when you don't, and I will help you understand what your options are to make a good decision for YOU.
